ORIGINAL - <br /> <br /> REVOCABLE LICENSE AGREEMENT <br /> (City Hall Plaza/Dasaro's LLC) <br /> This License Agreement ("Licens,,e,"), effective as of ~)-/'c~, 2002, is made by <br /> and between the City of Redwood City (City"), a municipal corpora~on and charter city <br /> ("Licensor"), and Dasaro's LLC, a California Limited Liability Corporation <br /> ("Licensee"). <br /> <br /> RECITALS <br /> <br /> A. Licensor is the owner of that certain real property commonly known as the <br /> City Hall Plaza and more specifically identified on the attached Exhibit "A" which is <br /> incorporated herein by reference (the "Property"). <br /> <br /> B. Licensor currently uses the Property as a public plaza, including public <br />access and seating and community events. <br /> <br /> C. Licensee is the operator of a restaurant/cafe located in a building <br />immediately adjacent to the Property. <br /> <br /> D. Licensee is desirous of placing pavers, planters, Licensor approved <br />screening elements, heat lamps, tables and chairs (the "Improvements") for outdoor <br />restaurant/cafe seating on the Property. <br /> <br /> E. The Property is of adequate shape and size to allow Licensee to place the <br />Improvements in substantially the same locations as specified in attached Exhibit "B' <br />which is incorporated herein by reference. <br /> <br />F. Licensor is willing to allow Licensee to place the Improvements on the <br />Property. <br /> <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> <br /> 1. Scope of License. Licensee recognizes that the Property's primary use is <br />for public activities and Licensee's use of the Property is secondary to the use of the <br />Property by the general public. Licensor hereby grants to Licensee a non-exclusive <br />license to enter upon and place the Improvements on the Property. <br /> <br /> 2. Term. This License expires one year from the date hereof and shall be <br />deemed automatically extended without amendment for a one-year period upon such <br />date and upon each anniversary of such date, unless otherwise revoked or terminated <br />by the parties. <br /> <br /> 3. Consideration. As a condition for the granting of this License, Licensee <br />will permit, without fee or charge, the general public to use the tables and chairs placed <br /> <br />F:Atty/Agr.008 <br />013102 <br /> <br /> <br />
