Code Section 27383 (4 <br /> <br />DECLARATION OF AFFORDABILlTY COVENANTS <br /> <br />THIS DECLARATION OF AFFORDABILlTY COVENANTS (this <br />"Declaration") is made on /Y1M~ /(" 2009, by SAN MATEO <br />COUNTY COMMUNITY COLLEGE DISTRICT ("Declarant") with respect to <br />certain property located at 4200 Farm Hill Road in the City of Redwood City, <br />County of San Mateo, California, as more fully described in the legal description <br />and map that comprise Exhibit "A" attached hereto and incorporated herein by <br />this reference (the "Property"). <br /> <br />WHEREAS, Declarant is the fee simple owner of the Property; and <br /> <br />WHEREAS, Declarant intends to develop the Property by <br />constructing a faculty/staff rental housing project consisting of approximately <br />sixty (60) housing units (the "Project"); and <br /> <br />WHEREAS, during its meeting of July 1, 2008, the Planning <br />Commission for the City of Redwood City approved a Planned Development <br />Permit for the Project, subject to certain Conditions of Approval (the "Conditions <br />of Approval"); and <br /> <br />WHEREAS, in accordance with the Conditions of Approval, <br />Declarant desires to maintain a minimum of nine (9) of the housing units as <br />affordable housing units; and <br /> <br />WHEREAS, Declarant desires this Declaration to serve as the <br />instrument to impose said covenants. <br /> <br />NOW THEREFORE, Declarant declares that the Property <br />described above is held and will be held, transferred, encumbered, used, sold, <br />conveyed, leased and occupied subject to the covenants, restrictions and <br />limitations set forth in this Declaration. All of the restrictions, covenants and <br />limitations will run with the land and will be binding on all parties having or <br />acquiring any right, title or interest in the Property described above or any part <br /> <br />1 <br />
