P- 243 <br /> <br />ORDINANCE OF THE BOARD OF PORT COMMISSIONERS OF <br />THE CITY OF REDWOOD CITY APPROVING AND <br />AUTHORIZING EXECUTION OF LEASE AGREEMENT WITH <br />LEHIGH SOUTHWEST CEMENT COMPANY <br /> <br />BE IT ORDAINED BY THE BOARD OF PORT COMMISSIONERS OF <br />THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> <br />Section 1. Public hearing having been duly noticed for, and held on <br /> <br />July 14, <br /> <br />, 2010, on the question of approval of the lease <br /> <br />agreement hereinafter described, and pursuant to the provisions of Section 48 <br /> <br />the Charter of the City of Redwood City, the Board of Port Commissioners of the <br /> <br />City of Redwood City does hereby approve that certain lease agreement entitled <br /> <br />"Lease Agreement - Lehigh Southwest Cement Company." (the "Lease <br /> <br />Agreement") by and between the City of Redwood City, acting by and through its <br /> <br />Board of Port Commissioners ("Port") and Lehigh Southwest Cement Company <br /> <br />("Tenant"), which Lease Agreement provides that the premises which are subject <br /> <br />to the Lease Agreement (the "Premises") shall be used for the purpose of <br /> <br />maintaining and operating storage and shipping facilities for cements, fly ash, <br /> <br />lime, rock, cement kiln dust, slag(s), pozzolan(s) and allied products and <br /> <br />commodities, and which Premises are generally described and depicted on <br /> <br />Attachment "A," attached hereto, as said Premises are more fully described in <br /> <br />the Lease Agreement. The term of the Lease Agreement is Two (2) years and <br /> <br />either party (Landlord or Tenant) has the right to terminate the Lease by delivery <br /> <br />of a 180 day written notice of termination to the other party.
