Code Section 27383 � <br /> DECLARATION OF AFFORDABILITY COVENANTS �� � <br /> THIS DECLARATION OF AFFORDABILITY COVENANTS (this <br /> "Declaration") is made on /✓1 n.�v�� i(e , 2009, by SAN MATEO <br /> COUNTY COMMUNITY COLLEGE DISTRICT ("DeclaranY') with respect to <br /> certain property located at 4200 Farm Hill Road in the City of Redwood City, <br /> County of San Mateo, California, as more fully described in the legal description <br /> and map that comprise Exhibit "A" attached hereto and incorporated herein by <br /> this reference (the `Property'). <br /> WHEREAS, Declarant is the fee simple owner of the Property; and <br /> WHEREAS, Declarant intends to develop the Property by <br /> constructing a faculty/staff rental housing project consisting of approximately <br /> sixty (60) housing units (the "ProjecY'); and <br /> WHEREAS, during its meeting of July 1, 2008, the Planning <br /> Commission for the City of Redwood City approved a Planned Development <br /> Permit for the Project, subject to certain Conditions of Approval (the "Conditions <br /> of Approval"); and <br /> WHEREAS, in accordance with the Conditions of Approval, <br /> Declarant desires to maintain a minimum of nine (9) of the housing units as <br /> affordable housing units; and <br /> WHEREAS, Declarant desires this Declaration to serve as the <br /> instrument to impose said covenants. <br /> NOW THEREFORE, Declarant declares that the Property <br /> described above is held and will be held, transferred, encumbered, used, sold, <br /> conveyed, leased and occupied subject to the covenants, restrictions and <br /> limitations set forth in this Declaration. All of the restrictions, covenants and <br /> limitations will run with the land and will be binding on all parties having or <br /> acquiring any right, title or interest in.the Property described above or any part <br /> 1 <br />
