LANDSCAPE MAINTENANCE AGREEMENT (2580 El Camino Real—Urban Housing Group} THIS LANDSCAPE MAINTENANCE AGREEMENT("AgreemenY'}is made and entered into � this � day of �i,�,� , 2012 {"Effective Date"), by and between URBAN HOUSING t REDWOOD CITY LLC, a Delaware limited liability company ("Developer"), and flie CITY 0� \ REDW�OD CITY, a charter city and California municipal corporation ("City") with reference to the following facts: RECITALS A, Reference is made to that certain real property situated in the City of Redwood City, County of San Mateo, State of California, commonly referred to as 2580 El Camino Real and described on Exhibit "A", attached hereto and incorporated by tl�is reference as if fully set forth herein {the "Propecty"). The Property is 6$ing developed as a condominium project, although it is expected that the Properiy wilt be oparated as a for-rent apartment oommunity for tha foreseeable future. I£the Property is ]ater sold as a condominium project then the interest in the Property will be transferred to a to-be-formed homeowner's association("H�A"}, a California nonprafit muYual benefit corporation, which HOA shall be ultimately responsible for the management,operation and governance of the Froperty. B. In connection with its development of the Property as a residential community, the Developer submitted to the Ciiy Construction Improvement Plans,wluch include, inter alia,landscaping plans for along the Propet�ty frontage("Plans"},alt of which Plans have been approved by the City. The Plans provide for installation of certain landscaping, pedestrian lighting, irriga�ion piping and controller ("Tmprovemants") within that portion of the City right of-way ("Maintenance Area"} as if�e Imp�•ovements and Maintenance Area are more specifically shown on E�ibit"B"attaehed hereto and by this reference made a part hereof. G. The Developer has submitted a final map for the Froperty, which has been reviewed by the City Engineer and is baing approved concurrently with this Agreement("Final Map"). D.
