The Property is 6$ing developed as a condominium project, although it is expected that the <br /> Properiy wilt be oparated as a for-rent apartment oommunity for tha foreseeable future. I£the Property is <br /> ]ater sold as a condominium project then the interest in the Property will be transferred to a to-be-formed <br /> homeowner's association("H�A"}, a California nonprafit muYual benefit corporation, which HOA shall <br /> be ultimately responsible for the management,operation and governance of the Froperty. <br /> B. In connection with its development of the Property as a residential community, the <br /> Developer submitted to the Ciiy Construction Improvement Plans,wluch include, inter alia,landscaping <br /> plans for along the Propet�ty frontage("Plans"},alt of which Plans have been approved by the City. The <br /> Plans provide for installation of certain landscaping, pedestrian lighting, irriga�ion piping and controller <br /> ("Tmprovemants") within that portion of the City right of-way ("Maintenance Area"} as if�e <br /> Imp�•ovements and Maintenance Area are more specifically shown on E�ibit"B"attaehed hereto and by <br /> this reference made a part hereof. <br /> G. The Developer has submitted a final map for the Froperty, which has been reviewed by <br /> the City Engineer and is baing approved concurrently with this Agreement("Final Map"). <br /> D.
