7.2.D. - Page 8 <br /> 3. Right -of -way dedications may be required in instances where the sidewalk is not <br /> contained within the existing right -of -way. Slope easements may need to be dedicated <br /> to contain the fill slope for new street improvements. <br /> 4. The property owner(s) /applicant shall be responsible for securing consent of adjacent <br /> property owners for proposed replacement of their fence, retaining wall, driveway, and <br /> other structures. Developer is responsible for providing advance notice to all property <br /> owners that might be affected by proposed construction. <br /> 5. The property owner(s) /applicant shall enter into a Construction Improvement Agreement <br /> with the City prior to the issuance of any permits. <br /> 6. The property owners) /applicant shall apply for and obtain a Revocable Encroachment <br /> Permit from the Engineering & Construction Services (E &C) Division, with approval by <br /> the City Council, for a structure, retaining wall, awning, or other features constructed in <br /> the public right- of-way, easement or on property in which the City holds an interest. <br /> 7. Any changes in the approved permit plans shall have prior approval of the Engineering & <br /> Construction Services Division, following the "Revisions" procedure in the Engineering <br /> Standards. <br /> 8. After the City permits are approved, but before beginning construction, the <br /> owner(s) /applicant shall hold a preconstruction conference with E &C staff and other <br /> interested parties. The developer shall arrange for the attendance of the construction <br /> manager, contractor, and all subcontractors who are responsible for grading and erosion <br /> and sedimentation protection controls. <br /> 9. The property owner(s) /applicant shall obtain a soils report, prepared by a licensed <br /> geotechnical engineer, in conformance with Engineering Standards, Volumes II & 11I. <br /> 10. The property owner(s) /applicant shall complete the City's "NPDES Permit Compliance <br /> Checklist ", and provide for permanent stormwater control measures selected from the <br /> City's "Local Source Control Measures List ", as appropriate. Refer to "Start at Source ", <br /> a Manual by BASMMA for guidance regarding appropriate stormwater treatment <br /> measures. <br /> 11. Normally scheduled construction activities shall adhere to the City's Noise Ordinance. If <br /> possible, the noisiest construction activities would be scheduled for daytime hours when <br /> the ambient noise levels are highest. <br /> 12. All construction equipment operated at the project site should be equipped with <br /> manufacturer's standard noise control devices (i.e. mufflers, engine enclosures, etc.). <br /> 13. All construction equipment shall be inspected by the contractor at periodic intervals to <br /> ensure proper maintenance and hence, lower noise levels. <br /> 14. Streets, sidewalks, and curbs & gutters in need of repair within and bordering the project <br /> shall be repaired and /or constructed and replaced in accordance with the standards. <br /> Photographs or video of before conditions are strongly recommended. <br /> Page 3 of 4 <br />
