B. - Page 75 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY APPROVING A USE PERMIT FOR THE <br /> CAMBRIDGE ACADEMY PROJECT PURSUANT TO THE CITY <br /> OF REDWOOD CITY ZONING ORDINANCE <br /> WHEREAS, Carol and Nicholas Berg ( "Applicants ") have applied for <br /> approval of a Use Permit to operate a transitional kindergarten through 8th grade <br /> private school with up to 180 students and 20 employees at the Redwood Baptist <br /> Church property, located at 2323 -2325 Euclid Avenue ( "Project "); and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> ( "Commission ") is empowered by Article 42 (Use Permits) of the City of Redwood <br /> City Zoning Ordinance to act upon applications for use permits; and <br /> WHEREAS, on December 10, 2013, the Commission conducted a duly <br /> noticed public hearing, in accordance with all applicable requirements of the <br /> California Environmental Quality Act ( "CEQA "), the State Planning and Zoning <br /> Law and the Redwood City Zoning Ordinance, to consider certification of the <br /> Final Environmental Impact Report for the Project, State Clearinghouse No. <br /> 2013012016 ( "Final EIR "), approval of Use Permit Application No. UP2012 -18, <br /> and received and considered oral and documentary evidence on the application; <br /> and <br /> WHEREAS, on December 10, 2013, the Commission considered and <br /> certified the Final EIR prepared by the City's Planning Services in accordance <br /> with the requirements of CEQA and, based on the certified Final EIR, considered <br /> and did not adopt a Statement of Overriding Considerations and a Mitigation <br /> Monitoring and Reporting Program ( "MMRP ") in compliance with all CEQA <br /> requirements, as part of the City's consideration of Use Permit Application No. <br /> UP2012 -18; and <br /> WHEREAS, on December 10, 2013, the Commission determined that <br /> approval of Use Permit Application No. UP2012 -18 would not further the purposes <br /> of and would not appropriately implement the City of Redwood City General <br /> Plan, applicable provisions of the Redwood City Municipal Code and Zoning <br /> Ordinance, denied the Use Permit application for the Cambridge Academy Project, <br /> and directed staff to return to the Commission with revised resolutions for denial <br /> of the Project; and <br /> WHEREAS, on February 4, 2014, the Commission reviewed revised Planning <br /> Commission Resolution Nos. 13 -29 and 13 -30, certifying the Final EIR, not adopting <br /> the Statements of Overriding Consideration or the Mitigation Monitoring and <br /> Reporting Plan, and denied the Use Permit application; and <br /> ATTY /RESO.3004 /CC RESO APPROVAL OF UP FOR 180 STUDENTS <br /> REV: 07 -22 -14 VR <br /> Page 1 of 8 <br />
