Reference is made to that certain real property situated in the City of Redwood City, <br /> County of San Mateo, State of California, known as the Redwood City Medical Center, 1100 Veterans <br /> Blvd., Redwood City, CA 94063, site and described on Exhibit "A ", attached hereto and incorporated by <br /> this reference as if fully set forth herein (the "Property"). The Properly is being developed as a medical <br /> services project. <br /> B. In connection with its development of the Property as a medical services project, the <br /> Developer submitted to the City plans approved by the City for construction which include, inter alia, <br /> landscaping plans for along the Property frontage ( "Plans "), all of which Plans have been approved by the <br /> City. The Plans provide for installation of certain landscaping, pedestrian lighting, irrigation, paths <br /> ( "Improvements ") within the City right-of-way ( "Maintenance Area") as the Improvements and <br /> Maintenance Area are more specifically shown on Exhibit "B" attached hereto and by this reference made <br /> a part hereof. <br /> C. The City and the Developer desire to enter into an agreement pursuant to which the <br /> Developer will maintain the Improvements within the Maintenance Area as both are depicted on <br /> Exhibit "B ". <br /> AGREEMENT <br /> NOW, THEREFORE, the City and the Developer (together, the "Parties ") hereby agree as <br /> follows: <br /> 1. PURPOSE OF AGREEMENT.
