City Attorney Thompson thanked the attorney who made the comments and said that <br /> she was surprised that she had not heard from this attorney in advance of the meeting <br /> since the item has been out since last Thursday. She provided additional wording for <br /> the CEQA portion of the ordinance. <br /> Vice Mayor Foust asked if what is before Council is enabling legislation to allow the City <br /> to do it and should the Council decide to do it. The City Attorney confirmed that the <br /> additional steps would come later if Council so decides to take these steps. The Vice <br /> Mayor commented that she encouraged the attorney to engage staff and have a less <br /> adversarial approach. She appealed to the owner of this building to come on board and <br /> be part of the solution and the great ideas that are going on. Another Council Member <br /> inquired about the outreach to others who are not on board and another Council <br /> Member made comments about the meaning of this tax and how it will help business <br /> owners. <br /> She said that this Attorney has mistaken the City's authority and power in accordance <br /> with the Charter. She said that there was a minor clerical edit that was needed on the <br /> ordinance and she will address that. She said that the point is that this is not a project <br /> under CEQA and if the motion includes making clerical edits this is not an issue. Ms. <br /> Thompson said that this is merely an ordinance that enables the future processes. <br /> One Council Member clarified that this is strictly enabling legislation but it is not <br /> establishing the Districts, and City Attorney Thompson confirmed that interpretation.. A <br /> suggestion was made that the person making the prior comments reaches out and <br /> communicates with the City since Redwood City is a very inclusive community. This <br /> Council Member would prefer that approach instead of an adversarial approach. <br /> Another Council Member inquired about extra efforts to reach out to those who did not <br /> respond to the survey. <br /> Mr. Brooks said that the next step is the petition drive to participate, voice their opinions <br /> or get engaged in this process. This Council Member said that having more people <br /> involved and aware is a good approach. <br /> M/S Aguirre/Foust to approve the items with edits as mentioned by the City Attorney as <br /> it relates to the CEQA portion of the Ordinance. Motion carries 6-1 by electronic vote <br /> with Council Member Howard abstaining and recused. <br /> C. Update on Planning Project by San Luis Obispo Students Related to the <br /> Broadway Corridor (Information Only) (613) <br /> Recommendation: <br /> Information only. <br /> Mr. Bill Ekern provided a brief report on this topic saying this project is about to wrap up <br /> but the goal was to give an update to Council. Council Member Aguirre said that she <br /> worked with the students, especially the ones from the University of Houston. She <br /> valued their ideas and fresh perspective.
