PUBLIC HEARING(S) <br /> A. Appeal of Planning Commission's Approval of a Planned Development <br /> Permit including Parking Modifications, Vesting Tentative Map and <br /> Condominium Permit approved by the Planning Commission for the <br /> Pete's Harbor Project, located at 1 Uccelli Boulevard (603) <br /> Mayor Gee set the ground rules for the public hearing and how he asked for respect of <br /> divergent views and focus on the subject matter at hand. <br /> Bill Ekern, Community Development Director, provided the staff report (presentation on <br /> file). He covered the key elements of the project and noted that the acreage has <br /> changed and so the project has 402 units due to a recalculation of the project because <br /> of the land area but the number of parking spaces remains the same. He reviewed the <br /> revised project density and noted that the resolution has been updated to show the <br /> eight items he explained in detail. <br /> Mr. Ekern then addressed and provided individual responses to the eight points on the <br /> appeal. He spoke about Condition #6 which has been added to the record and he said <br /> that basically all the permits need to be in before the development of the marina can <br /> take place. He further noted that it is a right to have a marina but not an obligation. <br /> Mayor Gee then introduced one of the appellants Ms. Tania Sole. Ms. Sole spoke <br /> under protest because Ms. Madden, the other appellant, is in the hospital and Ms. Sole <br /> reminded the city that it had requested a change in the process and Ms. Madden <br /> agreed to the change in the date. She commented that the City also did not agree to <br /> the bifurcation of the items tonight and said the city may be at risk for dispute. She <br /> made various allegations about the land and the area. She said the federal strip <br /> acreage should be removed from the development and that that Planning Commission <br /> should redraw the permits. She also spoke about traffic issues, a water trail destination, <br /> water quality issues, short notice for the appeal, attorney fees for the BCDC (San <br /> Francisco Bay Conservation and Development Commission), civil rights, the live- <br /> aboards, a BCDC permit needed for public access, and the General Plan, and she <br /> asked Council to consider the implications of rushing forward given the possible legal <br /> issues. <br /> CITY COUNCIL March 24, 2014 <br /> MEETING MINUTES PAGE 6 <br /> MINUTE BOOK NO. 65 <br /> Page No. 108 <br />
