• � 17.2. Additional Provisions. Performers will ensure that the policies of insurance required under#his Agreement contain, or are endorsed to contain, the following provisions: 17.2.1 For Commercial General Liability Insurance and Au�omobile Liability lnsurance: City, its officers, agents, volunteers and employees will be named as additional insureds. ��'�--' �i�/p,ip�r 2x t�,v.� � 17.2.2 Pertormers will obtain o�+/^.�t°ence coverage. � 17.2.3 This insurance will be in force during the life of the Agreement and any extensions of it and will not be canceled without thirty (30) days prior wr�tten notice to City sent pursuant to the Notice provisions of this Agreement. 17.2.4. If any of the above insurance policies are "claims made" policies, then Performers shall, in addition, for each such policy, provide additional insurance coverage providing an additional finro year extended reporting period for all claims arising out of the performance of this Agreement. 17.3 Providinq Certificates of Insurance and Endorsements. Prior to City's execution of this Agreement, PerFormers or their Agent will furnish certificates of insurance and endorsements to City. 17.4 Faiiure to Maintain CoveraQe. If Performers fails to maintain any of these insurance coverages, then City will have the option to declare Performers in breach, or may purchase replacement insurance or pay the premiums that are due on existing policies in order to maintain the required coverages. Pertormers are responsible for any payments made by City to obtain or maintain insurance and City may collect�these payments from Pertormers or deduct the amount paid from any sums due Performers under this Agreement. 17.5 Submission of Insurance Policies. City reserves the right to require, at anytime, complete and certified copies of any or all required insurance policies and endorsements. 17.6 Primary Coveraae. For any claims related to the Services and this Agreement, the Pe�formers' insurance coverage wiA be primary insurance with respect to City, its officers, agents, volunteers and employees. Any insurance or self-insurance maintained by City for itself, its officers, agents, volunteers a�d employees, will be in excess of Pertormers' insurance and not contributory with it. Performers will submit an endorsement evidencing that their Commercial General Liability Insurance and Automobile Liability Insurance coverages are primary and non-contributory.
