OFIGINAL <br /> AMENDMENT NO. 2 <br /> TO AGREEMENT FOR HISTORIC PROPERTY PRESERVATION <br /> (423 Beech Street) <br /> This Amendment No. 2 by and between the City of Redwood City, a charter city <br /> and municipal corporation of the State of California (hereinafter referred to as "City") and <br /> Alison Cartwright and Jay Saber (collectively, "Owner"), is entered into and effective as <br /> of the o2(o1►—day of November, 2002, amending the Agreement dated February 7, 1992 <br /> (the "Agreement"), by and between the City and Mark Weir (the "Original Owner") for the <br /> preservation of an historic structure located at 423 Beech Street, Redwood City, <br /> California (the "Structure"). <br /> RECITALS <br /> WHEREAS, on July 10, 1995, the Agreement was amended related to <br /> replacement of the Structure's roof; and <br /> WHEREAS, subsequent to the effective date of the Agreement, as amended, the <br /> Original Owner transferred his interest in the Structure to Owner; and <br /> WHEREAS, pursuant to Paragraph 8 of the Agreement, as amended, all <br /> agreements, rights, covenants, reservations and restrictions contained in the Agreement <br /> as amended, are binding on and inure to the benefit of the original parties as well as <br /> their successors and assigns; and <br /> WHEREAS, Owner wishes to update the Agreement's scope of work and timeline <br /> to preserve the property; and <br /> WHEREAS, on September 12, 2002, the City's Historic Resources Advisory <br /> Committee considered the Owner's proposal to update the Agreement's scope of work <br /> and timeline to preserve the property and voted to recommend the amendments to the <br /> City Planning Commission for consideration; <br /> WHEREAS, on September 17, 2002, the City Planning Commission considered <br /> the Owner's proposal to update the Agreement's scope of work and timeline to preserve <br /> the property and voted to recommend the amendments to the City Council for approval. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, City and Owner agree as follows: <br /> 1. The City consents to the Assignment of the Agreement, as amended, from <br /> Original Owner to Owner. <br /> 2.
