PACIFIC GAS AND ELECTRIC COMPANY <br /> GENERATING FACILITY INTERCONNECTION AGREEMENT <br /> (3` PARTY NON-EXPORTING) <br /> Generating Faciliry affirming Producer's intent and ability to continue to <br /> operate the Generating Facility. <br /> 4.3 Notwithstanding any other provisions of this Agreement, PG&E shall have the right to <br /> unilaterally file an application to terminate this Agreement with the Commission <br /> pursuant to the Commission's rules and regulations. <br /> 4.4 Any agreements attached to and incorporated into this Agreement shall terminate <br /> concurrently with this Agreement unless the Parties have agreed otherwise in writing. <br /> 5. GENERATING FACILITY OPERATION <br /> 5.1 Producer is responsible for operating the Generating Facility in compliance with all of <br /> PG&E's tariffs, including but not limited to PG&E's Electric Rule 21, and any other <br /> regulations and laws governing the interconnection of the Generating Facility. <br /> 5.2 The electric power produced by Producer's Generating Facility shall be used solely to <br /> serve electrical loads connected to the electric service account that PG&E uses to <br /> interconnect Producer's Generating Facility. Producer shall not use the Generating <br /> Facility to serve electrical loads that will cause Producer to be considered an <br /> "electrical corporation"as such term is used in Section 218 of the Public Utilities <br /> Code. <br /> 5.3 Producer shall regulate the electric power output of Producer's Generating Facility so <br /> as to prevent the flow of electric energy from the Generating Facility to PG&E's <br /> electric system. Unless otherwise agreed upon in writing by the Parties,this <br /> Agreement does not provide for, nor otherwise require PG&E to receive, purchase, <br /> transmit, distribute, or store the electrical power produced by Producer's Generating <br /> Facility. <br /> 5.4 The Generating Facility shall be operated with all of Producer's Protective Functions <br /> in service whenever the Generating Facility is operated in parallel with PG&E's <br /> Distribution System. Any deviation from these requirements may occur only when the <br /> Parties have agreed to such deviations in writing. <br /> 5.5 Producer shall not operate the Generation Facility in parallel with PG&E's Distribution <br /> System unless the Customer Agreement is in effect. If the Customer Agreement <br /> identified in Section 1.2 is terminated, Producer agrees to cease operating the <br /> Generating Facility in parallel with PG&E's Distribution System. <br /> Form 79-988 <br /> Automated Document,Preliminary Statement Part A Advice 4110-E <br /> Revised September 2012 <br /> Page 4 of 15 <br />
