CONTINGENCY <br /> Notwithstanding the foregoing, or any language to the contrary, the RCSD and <br /> CONTRACTOR agree and acknowledge that this Agreement and the parties' respective <br /> obligations thereunder are entirely contingent upon the RCSD's receipt of anticipated <br /> California Department of Education After School Education and Safety (ASES) Program <br /> and/or Federa121 St Century Community Learning Centers (21 St CCLC) grant funding for <br /> 2013-14 year, in an amount sufficient to cover the sum set forth above. In the event that <br /> the RCSD does not receive the anticipated state and federal grant funding, this <br /> Agreement shall be null and void,with no penalty to either party. <br /> Initial / <br />
