f <br /> 9.A. - Page 66 <br /> CHAPTERBBv <br /> Draft ALUCP Compatibility Factor Maps and <br /> Policies <br /> 3.14ntroductionv <br /> In 1994, a section was added to the State Aeronautics Act to require that: "An airport land use <br /> commission that formulates, adopts or amends a comprehensive airport land use plan shall be <br /> guided by information prepared and updated pursuant to Section 21674.5 and referred to as the <br /> Airport Land Use Planning Handbook ..."(PUC Section 21674.7). The addition of this statute <br /> changed the role of the Handbook from a useful reference document to one that must be used as <br /> guidance in the development of ALUC policies. <br /> Tableo3-1 compares policies from the 1996 CLUP/ALUCP for San Carlos Airport to the <br /> recommendations provided in the 2011 Handbook. As presented in Table 3-1,noise policies <br /> included in the 1996 CLUP are more stringent than guidance contained in the 2011 Handbook, <br /> which recommends use of a Community Noise Equivalent Level(CNEL)of 60 decibels (dB)as <br /> the land use compatibility planning threshold for airports in urban/suburban areas; the 1996 <br /> CLUP establishes CNEL 55 dB as the"noise impact boundary"for San Carlos Airport. In <br /> contrast, safety policies included in the 1996 CLUP are limited and generally not as protective as <br /> the recommended safety compatibility criteria contained in the 2011 Handbook. <br /> The 1996 CLUP established an avigation easement review area(AERA)for San Carlos Airport to: <br /> • Prevent the creation of airport/airspace hazards and to preserve unobstructed airspace; <br /> • Prevent the impairment of the utility of San Carlos Airport and the public investment <br /> reflected therein; and <br /> • Provide current affected property owners and subsequent affected property owners with <br /> formal notice that their properties are located near San Carlos Airport and may be subject <br /> to impacts from the airport and/or aircraft operations. <br /> In 2002,Assembly Bill 2776 (Simitian) amended the Business&Professions Code to require <br /> additional notifications in real estate transactions related to proximity to airports and possible <br /> associated annoyances. Considering the real estate disclosure requirements included in the <br /> Business&Professions Code and FAA noticing requirements incorporated into Federal Aviation <br /> Regulations (FAR)Part 77,Safe, Efficient Use and Preservation of the Navigable Airspace,the <br /> AERA and associated policies in the 1996 CLUP are likely redundant and no longer required. <br /> SanfCarlosfAirportV 3-1 ESAfAirportsfl130753f <br /> ALUCPfWhitefPape/ Junef2014f <br />
