B PCompatibilitIFactorsf EvaluatedtinnALUCPst <br /> 9.A. - Page 145 <br /> Standard avigation easement provisions include the following: <br /> • A right-of-way for free and unobstructed passage of aircraft through the airspace over the <br /> property at any altitude above an imaginary surface specified in the easement(usually set in <br /> accordance with FAR Part 77 criteria). <br /> •f A right to subject the property to noise,vibration, fumes, dust, and fuel particle emissions <br /> associated with normal airport activity. <br /> • A right to prohibit the erection or growth of any structure,tree, or other object that would <br /> enter the acquired airspace. <br /> • A right-of-entry onto the property,with appropriate advance notice, for the purpose of <br /> removing,marking or lighting any structure or other object that enters the acquired <br /> airspace. <br /> • A right to prohibit electrical interference,glare,misleading lights,visual impairments, and <br /> other hazards to aircraft flight from being created on the property. <br /> The existing San Carlos Airport CLUP has an avigation easement review area. The ALUCP <br /> update process will consider potential revisions to the current avigation easement policy. <br /> AcousticalvTreatment of Structuresw <br /> Another requirement which ALUCs should establish as a condition for development in special <br /> circumstances is acoustical treatment of structures. State law requires that"interior noise levels <br /> attributable to exterior sources shall not exceed 45 dB in any habitable room" (California <br /> Building Code, Section 1207.11.2). The code applies this standard only to new hotels,motels, <br /> dormitories, apartment houses, and dwellings other than single-family residential. However, <br /> many local jurisdictions—usually as a policy in the noise element of their general plan—have <br /> extended the requirement to single-family residences.ALUCs should do likewise. <br /> The code indicates that an acoustical analysis is necessary anywhere the annual CNEL exceeds <br /> 60 dB.
