with the Director of Finance, or, in the event no designated beneficiary has been chosen, the <br /> beneficiary listed in the worker's insurance policy will receive the payment of such unused sick <br /> leave as provided under the provisions for a worker who elects to receive compensation in lieu of <br /> sick leave credits. Workers discharged shall not be eligible for payment of unused sick leave. <br /> 20.1.8 If a worker's illness or the illness of a family member results in an absence from work for three (3) <br /> or more consecutive days, a doctor's certificate or other reasonable medical proof of illness may be <br /> required by the City. <br /> 20.1.9 If a supervisor believes there is an abuse of sick leave, the supervisor may require the worker to <br /> provide medical verification for all future sick leave absences for a period of 90 days. Prior to <br /> implementing this provision the worker and the worker's representative shall, upon request, be <br /> given the opportunity to meet with the supervisor to show cause why this provision should not be <br /> invoked. Material relating to the sick leave use will be available to the worker and his <br /> representative prior to such meeting. <br /> 20,1.10 Pursuant to Article 20.13 and City policy, a worker may also request family and medical leave if <br /> he/she is unable to perform his/her job because of a serious health condition, or needs to care for a <br /> child,following birth or placement,or needs to care for a spouse, child or parent who is seriously ill. <br /> 20.2 Industrial Disability Leave <br /> 20.2.1 A regular worker who is in the service of the City as of March 31, 1983, who suffers any disability <br /> arising out of and in the course of his/her employment, as defined by the Workers' Compensation <br /> laws of the State of California, shall be entitled to industrial disability leave without loss of <br /> compensation for the period of such disability to a maximum of one (1) year. Regular workers <br /> hired on April 1, 1983, or thereafter, shall be entitled to industrial disability leave in accordance with <br /> work restrictions prescribed by a Qualified Medical Evaluator without loss of compensation for the <br /> period of such disability to a maximum of sixty(60)days or until retirement, whichever occurs first. <br /> During the period the worker is paid by the City, the worker shall assign or endorse to the City any <br /> benefit payments received as a result of Workers' Compensation insurance coverage. The City <br /> reserves the right to withhold payment of any disability benefits until such time as it is determined <br /> whether or not the illness or injury is covered by Workers'Compensation. <br /> 20.2.1.1 In the event that the City exercises its right to withhold immediate payment of <br /> disability benefits, and until such time that a coverage determination is made, workers <br /> may elect to utilize accrued sick leave for the interim period. If accrued sick leave <br /> becomes exhausted, workers may then elect to utilize accrued vacation leave for any <br /> remaining interim time. <br /> 20.2.2 Workers shall not accrue sick leave or vacation leave credits during any period of disability <br /> exceeding one (1) month. <br /> 20.2.3 A worker hired after April 1, 1983, who is still unable to return to duty after exhausting paid <br /> industrial accident leave may, at the discretion of the worker, be placed on paid sick leave if he/she <br /> is eligible therefore. Accumulated sick leave will be reduced, at the discretion of the worker, only in <br /> the amount necessary to provide less than equal to a full day's wages or salary, as indicated in the <br /> worker's assignment, when added to compensation without penalties from the City's Workers' <br /> Compensation insurance carrier. <br /> 32 <br />
