REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />September 22, 2014 <br /> <br />SUBJECT <br />Amendment No. 1 to the License Agreement with Silicon Valley Clean Water ("SVCW" <br />previously known as South Bayside System Authority "SBSA") for use of city property <br />near Maple Street <br /> <br />RECOMMENDATION <br />By motion, approve and authorize the City Manager to execute Amendment No. 1 to <br />extend the term of the agreement for SVCW's use of City property known as the "former <br />sewage treatment plant site" to accommodate SVCW's construction of their 48-inch <br />Forcemain Reliability Improvement Project. <br /> <br />By motion, approve and authorize the City Manager to execute Amendment No. 2 to <br />extend the term of the agreement for Former Sewage Treatment Plant Site-Dealer <br />Parking Group (“Amendment No. 2 to Auto Dealers Agreement”) to accommodate <br />SVCW’s construction of their 48-inch Forcemain Reliability Improvement Project. <br /> <br />BACKGROUND <br />Silicon Valley Clean Water (SVCW) is in the process of replacing a 48-inch pressurized <br />transmission main near Maple Street. On July 22, 2013, Council approved the license <br />agreement that allows SVCW to use City property known as the “former sewage <br />treatment plant site” as a construction staging area and a temporary public by-pass <br />road. The term of the original agreement ends September 16, 2014. The City Manager <br />has the right to extend the term on a month-to-month basis for up to an additional three <br />months after September 16, 2014. However, SVCW has modified their projected <br />completion date and has need of the property for an additional five months to <br />accommodate their on-going construction activity. The City and several Auto Dealers <br />have an agreement for use of this property. The term of this agreement will need to be <br />extended as well in order to accommodate the SVCW agreement. <br /> <br />ANALYSIS <br />The proposed amendment is consistent with Council’s original intent to make certain <br />City owned property available to SVCW for the duration of their construction project. <br />The City is part owner of the Authority and benefits from the construction of the specific <br />project. Staff is unaware of adverse impacts generated by the existing construction <br />activity or of other reasons not to extend the term and thereby accommodate SVCW’s <br />revised projected completion date. <br /> <br />7.1.F. - Page 1
