Nothing in this Resolution shall be construed to <br />reduce or alter the City’s regulatory authority with respect to the construction or installation <br />any Improvements or to delegate to the Authority any land use or zoning powers or <br />obligations of the City, including powers and obligations with respect to permits or <br />inspections. Specifically, the City makes no representation that it will refrain from <br />amending its ordinances and regulations related to Improvements. <br /> <br />SECTION 11. Financial Obligations. Nothing in this Resolution shall be <br />construed to authorize CEDA to in any way commit, pledge or obligate any funds or <br />property of City for any purpose. <br /> <br />SECTION 12. Use of City Name. Nothing in this JPA Amendment shall be <br />construed to authorize Authority to file any action, record any document, or make any <br />demand in the name of City. Any powe r of City that is delegated to CEDA by this <br />Resolution or by virtue of the City’s membership in CEDA shall be exercised by CEDA in <br />its own name, and not in the name of the City. CEDA shall not represent to any person for <br />any purpose that the Figtree Pace Program is a program of City, that the City has <br />designed the program, that City is responsible for the administration of the program, or that <br />the City makes any representation regarding the appropriateness of the program for any <br />particular property, improvement, property owner, or situation. <br /> <br />SECTION 13. CEQA. The City Council hereby finds that adoption of this Resolution <br />is not a "project" under the California Environmental Quality Act (“CEQA”), because the <br />Resolution does not involve any commitment to a specific project which may result in a <br />potentially significant physical impact on the environment, as contemplated by Title 14, <br />California Code of Regulations, Section 15378(b )( 4)). <br /> <br />SECTION 14. Effective Date. This Resolution shall take effect immediately upon <br />its adoption. The City Clerk is hereby authorized and directed to transmit a certified copy of <br />this resolution to Figtree Energy Financing. <br /> <br />SECTION 15. Costs.
