If Contractor fails to comply with these insurance <br />requirements, then City will have the option to declare Contractor in breach, or may <br />purchase replacement insurance or pay the premiums that are due on existing policies in <br />order to maintain the required coverages. Contractor is responsible for any payments <br />made by City to obtain or maintain insurance and City may collect these payments from <br />Contractor or deduct the amount paid from any sums due Contractor under this <br />Agreement. <br /> <br />7.5 Submission of Insurance Policies. City reserves the right to require, at any time, <br />complete copies of any or all required insurance policies and endorsements. <br /> <br /> 8. Nondiscrimination and Equal Opportunity. During the performance of this <br />Agreement, Contractor shall not discriminate against any employee or applicant for employment <br />because of race, religion, creed, color, national origin, sex, sexual orientation or age. <br /> <br />9. Prevailing Wage Rates <br />A. This is a public works project. Contractor shall pay prevailing wages for all employees <br />working on this project and shall include in all subcontracts a requirement that all <br />subcontractors pay prevailing wages. Contractor and all subcontractors shall comply with <br />all applicable requirements of .California Labor Code §§1720 et seq. <br />B. Copies of the general prevailing rates of per diem wages for each craft, classification, or <br />type of worker needed to execute the Contract, as determined by Director of the State of <br />California Department of Industrial Relations, are on file at City’s office and are deemed <br />included in this contract. Contractor shall post the applicable prevailing wage rates at the <br />job Site. The City has a web site (www.redwoodcity.org), which is linked to the <br />Department of Industrial Relations, where Contractor may obtain prevailing wage data. <br />C. If workers in any apprenticeable craft or trade, will be employed on the Project, Contractor <br />shall submit contract award information containing the information requested in DAS form <br />140, to apply to the joint committees administering the apprenticeship standards of the craft <br />or trade within the area of the Project, for a certificate approving Contractor under the <br />apprenticeship standards for the employment and training of apprentices, in accordance <br />with section 1777.5 of the California Labor Code and section 230 of Title .8 of the <br />California Code of Regulations. Such notice shall be submitted within ten (10) days of the <br />date of the execution of this Contract, but in no event later than the first day in which a <br />worker is employed on the project. <br />D. Contractor shall comply with the requirements in Labor Code Sections 1810 et seq <br />concerning hours in a workday and week and overtime. <br />E. Contractor shall comply with Labor Code Section 1776, regarding certified payroll records. <br /> <br />7.1.D. - Page 30
