09/22/2014 WHEREAS, the City's associate membership in the Authority would permit the Authority to exercise the City's authority to establish and implement a contractual assessment program within the City under Chapter 29; and WHEREAS, participation in a contractual assessment program that is common to a number of cities and/or counties permits allows for administrative efficiencies and economies of scale that would not be possible if the City independently exercised its authority under Chapter 29 to create its own contractual assessment program; and WHEREAS, the City will not be responsible for (i) the conduct of any assessment proceedings or other proceedings under Chapter 29; (ii) the levy and collection of assessments; (iii) the conduct or prosecution of any remedial action in the case of delinquencies in the payment of any assessments; or (iv) the issuance, sale or administration of any bonds issued in connection with the California HERO Program; and WHEREAS, the City will have no financial obligation to the Authority (or the holders of any bonds or other debt issued by the Authority); and WHEREAS, the City will not pledge any money or assets of the City as a guarantee of any contractual assessment levied in connection with the California HERO Program (or as a guarantee of any bond or debt issued to fund Improvements in connection with such a contractual assessment); and WHEREAS, Chapter 23 requires that contractual assessments in connection with the California HERO program will be levied by only with the free and willing consent of the owner of each lot or parcel on which an assessment is levied at the time the assessment is levied. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: SECTION 1. The recitals set forth above are true and correct in all respects. SECTION 2. This City Council consents to inclusion in the California HERO Program of all of the properties in the incorporated territory of the City. No assessment shall be levied by the Authority against any parcel in the City except upon the request by and voluntary agreement of owners of the properties, in compliance with the laws, rules and regulations applicable to the California HERO Program. SECTION 3. The consent of this City Council constitutes assent to the assumption of jurisdiction under Chapter 29 by the Authority for the purpose of implementing the California HERO Program and authorizes the Authority, upon ATTY/RESO.3015/CC HERO PROGRAM RESO.#15370 REV:9-12-14 PT MUFF#803 Page 2 of 9
