AMENDMENT NO. 1 TO AGREEMENT FOR 2014 JARDIN DE NINOS PARK RENOVATION PROJECT (Guerra Construction Group) This Amendment No. 1 is entered into and effective as of the ��day of ��r1,v,9- , 2015, amending the agreement dated September 30, 2014 (the "Agreement") by and befinreen the City of Redwood City, a charter city and municipal corporation ("City"), and Guerra Construction Group ("Consultant") (collectively, the "Parties") for the 2014 Jardin De Ninos Park Renovation Project. RECITALS A. On September 30, 2014, the Parties executed the 2014 Jardin De Ninos Park Renovation Project Agreement; and B. The Parties have negotiated and agreed to amend the Agreement to reflect additional requirements relating to City fencing. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the Parties agree as follcws: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Consultant agrees to provide those services described below in paragraph 2. 2. The Agreement is amended by adding new paragraph F to Section VII "Miscellaneous" as follows: VII. Miscellaneous F. The Contractor shall maintain the safety fencing provided by the City for the Jardin de Ninos Park Renovation Project during the Term of this Agreement as follows: The fence will be placed at the site per the Traffic Control Plan (attached to this Amendment as Exhibit A) and the instructions below shall be followed by Contractor: • The fence or fence bases shall not encroach into the travel lanes or bike lanes at any time. • All fence panel bases or footings shall be covered with two sand bags (city- furnished) and one standard 28" tall orange traffic cone with finro retro-reflective stripes at all times. Contractor shall provide and install cones. • The contractor shall maintain all the existing signage per the traffic control plan, including project sign board. • The green dust control fabric shall be kept up during construction with the exception of the corner to allow for vehicular visibility at Chestnut Street and Middlefield Road (finro panels back from corner in both directions). • The contractor shatl promptly remove any graffiti on or around fencing and safety equipment.
