7.1.F. - Page 9 <br /> In the event a successful Bidder fails to provide the vehicle within the time specified and the <br /> contract is canceled, the City may enter into an agreement with the next lowest Bidder for <br /> delivery of the specified vehicle (s) in this document. <br /> 18. ERRORS AND OMISSIONS <br /> The Bidder will not be allowed to take advantage of any error or omission in their Submitted <br /> Bid. <br /> 19. FEDERAL AND STATE TAXES <br /> The prices bid shall include any Federal tax, exclusive of Federal Excise Tax heretofore <br /> imposed by Congress, which is applicable to the material to be furnished. If any sales tax, <br /> processing tax, adjustment charge or other taxes or charges are imposed or changed by <br /> Congress after the date set for opening bids and made applicable directly upon the production, <br /> manufacture or sale of the supplies to be furnished, and are paid by the Supplier on the articles <br /> or supplies furnished, then the prices stated in the schedules will be increased or decreased <br /> accordingly, and any amounts due the Supplier as the result of such changes will be charged <br /> to the City and added on vouchers (or invoices) as separate items, <br /> 20. PAYMENTS <br /> Payment will be made promptly following delivery, inspection, and acceptance of goods by <br /> the City and receipt of invoice. <br /> 21. BIDDER'S STATEMENT <br /> If awarded the contract, the undersigned hereby agrees to supply the vehicle(s) and equipment <br /> according to specifications within the stated time period ( "maximum number of days till <br /> delivery to Redwood City ") commencing upon receipt of the Purchase Order by the <br /> Successful Bidder. <br /> If the unit price and the total amount named by a Bidder for any item do not agree, it will be <br /> assumed that the error was made in computing the total amount and the unit price alone will <br /> be considered as representing the Bidder's intention. <br /> The undersigned has checked carefully all the figures listed in the Bid Proposal Form and <br /> understands that the City will not be responsible for any errors or omissions on the part of the <br /> undersigned in making up this bid. <br /> The undersigned hereby certifies. that this bid is genuine, and not sham or collusive, or made <br /> in the interest or in behalf of any person not named herein, and that the undersigned has not <br /> directly or indirectly induced or solicited any other Bidder to put in a sham bid, or any other <br /> person, firm or corporation to refrain from bidding, and that the undersigned has riot in any <br /> manner sought by collusion to secure for himself an advantage of any kind whatever. <br /> The undersigned acknowledges he or she is responsible for all costs incurrent in the <br /> development and submission of their bid, the City assumes no contractual obligation as a <br /> result of this Notice Inviting Bids, the City shall not be contractually bound until the City <br /> issues a Purchase Order to the Successful Bidder. <br /> 6IPage <br />
