Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> 601 Brewster — Palacio Apartments <br /> THIS IMPROVEMENT AGREEMENT ( "Agreement ") is made and entered into on this _ day of _ <br /> , 20 ( "Effective Date ") by and between Fuller Street Partners, a California limited <br /> liability company ( "Developer "), and the CITY OF REDWOOD CITY, a charter city and <br /> California municipal corporation ( "City") with reference to the following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting of <br /> approximately 0.88 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B. On March 18, 2014, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 14 -04, approving the Tentative Map for 439 Fuller Street <br /> ( "Project "), prepared by Bowman Consultants and dated February 3, 2014 ( "Tentative Map "), subject to <br /> certain conditions of approval ( "Conditions "). After approval of the Tentative Map and associated <br /> documents, the project began to use the address 601 Brewster for subsequent submittals. <br /> C. The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the parcel map ( "Final Map "), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled 601 Brewster <br /> Improvement Plans, prepared by JMH Weiss, Inc and dated September 8, 2014 (the "Improvement <br /> Plans "), which, in addition to other improvements, provide for certain public improvements consisting of <br /> street and street light improvements, storm drain systems, domestic water systems and sanitary sewer <br /> systems for the Project (collectively, "Improvements "). <br /> F.
