7.1.B. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> December 8, 2014 <br /> SUBJECT <br /> Amendment No. 1 to Extend the Agreement with Moore, lacofano and Goltsman, Inc. <br /> (MIG) for On-Call Environmental Consulting Services for Projects within the Downtown <br /> Precise Plan (DTPP). <br /> RECOMMENDATION <br /> By motion, approve and authorize the City Manager to execute Amendment No. 1 to <br /> extend the agreement with MIG in the amount of $100,000, for a total agreement <br /> amount of $200,000, allowing work to evaluate individual project applications on a time <br /> and materials basis for consistency with the Downtown Precise Plan EIR. <br /> BACKGROUND <br /> On February 11, 2013, the City Council authorized the City Manager to execute an <br /> agreement with MIG allowing individual project applications to be reviewed on a time <br /> and materials basis with a cost not to exceed $100,000. The purpose of the agreement <br /> was to allow MIG to provide a review of development proposals to determine <br /> consistency with the environmental analysis prepared for the DTPP. MIG has been <br /> particularly well-suited for this task as they were the authors for the DTPP EIR. City staff <br /> has been responsible for the review of downtown development proposals for <br /> consistency with the DTPP and any other development requirements. The agreement <br /> with MIG has helped to streamline the entitlement process during an extremely active <br /> real estate development climate. MIG has reviewed six DTPP development proposals <br /> during the term of the original contract. Downtown development has remained at a high <br /> level. In August 2014, the Planning Division accepted applications for six development <br /> proposals within the DTPP area. In the February 11, 2013 staff report to Council, staff <br /> indicated that should development demands exceed expectations and the original <br /> contract amount, an amendment request would be prepared for Council consideration. <br /> The full cost of consultant work, as well staff time to oversee the environmental and <br /> application process, is reimbursed to the City by the developer. <br /> ANALYSIS <br /> As Downtown development continues to remain at a high-level, demonstrated by the <br /> number of applications recently received by the Planning Division, the need to continue <br /> a streamlined entitlement review process is evident. As in the original agreement, City <br /> staff would forward pertinent proposed development application materials to MIG for <br /> concurrent environmental review. MIG would produce an Initial Study for each project <br />
