5. Citv Ri�hts and Resuonsibilities. <br /> 5.1 Administration. This Agreement shall be administered by the City Manager or his/her <br /> designee(referred to herein as"City")on behalf of the City. The City agrees to: <br /> 5.1.1 Coordinate the collection of the annual Assessments through an agreement <br /> with the County of San Mateo; ensure the billing of those public or tax-exempt entities <br /> not billed through the County of San Mateo property t� billing procedures; and <br /> monitor the payment process to obtain timely payment of Assessments by public <br /> entities and other tax-exempt District property owners; <br /> 5.1.2 Provide timely District property tax roll information to the County of San Mateo <br /> Auditor-Controller in order to include the annual Assessment amounts on the County's <br /> property tax bills; <br /> 5.1.3 Provide general information to RCIA,the assessed property owners, and the public; <br /> 5.1.4 Direct the disbursement of collected Assessments to RCIA in accordance with this <br /> Agreement and the approved Annual Report and Budget; and <br /> 5.1.5 Perform other related tasks, as agreed to by the City. <br /> 5.2 Bud�et. The City will carry out all actions reasonably necessary for processing the annual <br /> budget of the District. T'he City may, at its sole discretion, reject or accept any proposed <br /> budget change from that set forth in the District Plan. <br /> 5.3 RESERVED. <br /> 5.4 Discrepancies and Assessment Disputes. The City may assist with the resolution of any <br /> discrepancies in individual Assessment amounts or calculations and has the authority to: <br /> 5.4.1 Conduct reviews and or audits of any Assessment related data; verify Assessment data <br /> as compiled by any consultant, sub-consultant, or other party hired by RCIA; perform <br /> field or on-site inspections to verify the accuracy of Assessment data or investigate any <br /> property owner claims concerning the accuracy of any Assessment data. <br /> 5.4.2 Recalculate the Assessment amount due and request the San Mateo County Auditor- <br /> Controller (the "CAC") to make the requested adjustments. Provided, however, that if <br /> the CAC does not honor the City's request to recalculate the Assessment the City shall <br /> not be liable in any way for any Assessments other than its own, and shall not be <br /> obligated to pursue any action against the CAC to obtain any adjustment or <br /> recalculation. <br /> 5.5 Disbursements. The Assessments will be collected through the County property tax collection <br /> procedures and will be received to the City pursuant to agreements between the City and <br /> County. Except for the costs defined in Paragraph 5.5.1 and 5.6, below, City shall disburse <br /> the entire collected Assessments to RCIA pursuant to the terms and conditions of this <br /> ATTY/AGR/2015.002/RWC CBID OPERATING AGREEMENT <br /> REV:O1-05-2015 PT <br /> Page 8 of 19 <br />
