7.4.A. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> January 26, 2015 <br /> SUBJECT <br /> Amend Procedural Ordinance Regarding Provision of Improvements and Activities of Community <br /> Benefit Improvement Districts <br /> RECOMMENDATION <br /> Waive Second Reading and Adopt Ordinance Adding New Section 31.15 to Chapter 31 of the <br /> City's Code Relating to the Provision of Improvements and Activities by Community Benefit <br /> Improvement Districts. <br /> BACKGROUND <br /> During its January 12, 2015 meeting, the City Council introduced an ordinance adding New <br /> Section 31.15 to Chapter 31 of the City's Code Relating to the Provision of Improvements and <br /> Activities by Community Benefit Improvement Districts. This ordinance clarifies the procedures <br /> applicable to community benefit improvement districts when engaging third parties to perform <br /> work in the applicable district. The ordinance is presented at this meeting for second reading <br /> and adoption. <br /> ANALYSIS <br /> The proposed Council action serves to allow the addition of the new Section 31.15 to Chapter <br /> 31 of the City's Code. <br /> ALTERNATIVES <br /> Council may choose not to adopt the Ordinance and not allow the section to be added. <br /> FISCAL IMPACT <br /> There is no fiscal impact associated with adding this section to the City's Code. <br /> ENVIRONMENTAL REVIEW <br /> This action is not a "project" within the meaning of the California Environmental Quality Act <br /> because this ordinance amendment sets forth a procedural and administrative mechanism <br /> relating to assessments and therefore it has no potential for resulting in either a direct physical <br /> change in the environment nor a reasonably foreseeable indirect physical change in the <br /> environment.
