Contractor/Owner <br /> grants to the City of the right to take any and all legal action necessary to enforce <br /> the provisions of this restrictive covenant, and owner will be responsible for all <br /> reasonable legal expenses incurred by the City in the enforcement of this <br /> restrictive covenant. Within the CDBG program guidelines, the City will have the <br /> right to waive any and all breaches of the terms of the Affordability Covenants, <br /> but any such waiver shall not be deemed a waiver of any previous or subsequent <br /> breaches. <br /> Affirmative Marketing. Projects containing five or more units, regardless of <br /> funding source, must comply with affirmative marketing responsibilities that meet <br /> federal and state requirements. Contractor shall give preference to qualified first <br /> time homebuyer applicants that are either cuRent residents of the City of <br /> Redwood Cifiy or will move closer to employment based in Redwood City. <br /> Contractor shall include as part of its marketing eiforts, outreadi to homeless and <br /> at-risk of being homeless households transitioning through one of the various <br /> homelessness assistance programs operating in the City of Redwood City. <br /> Contractor shall market accessible uniUs to persons with disabilities and make <br /> every effort to ensure accessible unit/s are purchased by disabled households. <br /> Prospective applicants must demonst�ate willingness to pay and ability to partner <br /> in the construction of self-help ownership housing. Qual�ed applicants may not <br /> have owned nor had any ownership interest in any real property, whether or not <br /> such real property was the applicant's primary residence, within the last three <br /> years. Contractor shall submit affirmative marketing plan to City prior to <br /> disbursement of funds under this Agreement. <br /> Eligible Households. To be a "Eligible Household", the purchaser must have an <br /> income, certified by the City or its designee, which is between 50 and 80 percent <br /> of Area Median Income (AMI) established by the U.S. Department of Housing <br /> and Urban Development (HUD) for the County of San Mateo. In order to ensure <br /> compliance with this Agreement in connection with the sale and transfer of each <br /> Affordable Unit, Contractor and its successors shall obtain a copy of each <br /> prospective purchaser's federal income tax return for the taxable year <br /> immediately preceding the proposed purchase of an Affordable Unit and cuRent <br /> income infoRnation such as wage statements or, if the prospective purchaser <br /> certifies and declares under penalty of perjury that he or she did not file a federal <br /> tax retum, other evidence of income for such year acceptable to the City in its <br /> sole discretion and current income information such as wage statements, to <br /> substantiate that the prospective purchaser meets the eligibility requirements of <br /> qualified buyers. In the event the City is unable to make a determination that a <br /> prospective buyer is a qualified buyer based upon the information provided, the <br /> prospective purchaser shall be determined not to meet the requirements of a <br /> qualified buyer and shall be disqualified from purchase. <br /> Maximum Affordable Sales Price.
