4. Amendments to Paraqraph 2. Use of Funds. All of Original Agreement <br /> Paragraph 2 (Use of Funds) after the title is hereby designated as subparagraph (a), and the <br /> following is hereby added as a new subparagraph (b): <br /> (b) Contractor will use the funds provided pursuant to Paragraph 1(b) solely <br /> for the Project objectives described in Exhibit B (and Exhibit D if applicable), attached <br /> hereto and by this reference incorporated herein. Contractor shall perform services as <br /> described in Exhibit D in consideration of the payments set forth in Paragraph 4(b). <br /> 5. Amendments to Paraqraph 4. Pavments. All of Original Agreement Paragraph <br /> 4 (Payments) after the title other than the last sentence is hereby designated as subparagraph <br /> (a), the last sentence is hereby designated paragraph (c), and the following is hereby added as <br /> a new subparagraph (b): <br /> (b) No more frequently than monthly, Contractor may submit expense <br /> documentation, including invoice(s), proof(s) of payment and a schedule of expenditures <br /> including sources and uses, in form and substance reasonably satisfactory to City's <br /> Housing Manager for payment in accordance with the provisions of Exhibit D. Provided <br /> that the Contractor has complied with all conditions precedent, the City shall pay to <br /> Contractor up to a total of $276,493 within 30 days of receiving each payment request. <br /> City shall not be obligated to pay Contractor for the services covered by any invoice if <br /> Contractor presents the invoice to City on or after June 30, 2016. <br /> 6. No Other Modifications. Except as specifically modified herein, the Original <br /> Agreement remains in full force and effect. To the extent that any provision of this Amendment <br /> conflicts with any provisions of the Original Agreement, this Amendment shall control. <br /> 7. Miscellaneous. The individuals executing this Amendment and the instruments <br /> referenced in it on behalf of Contractor each represent and warrant that they have the legal <br /> power, right and actual authority to bind Contractor to the terms and conditions of this <br /> Amendment.
