<br /> 04/26/20047 <br /> ORIGINAL <br /> ORDINANCE NO. 2261 <br /> ORDINANCE OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> APPROVING AND AUTHORIZING EXECUTION OF THE SECOND <br /> AMENDMENT TO THE FRANCHISE AGREEMENT WITH BFI WASTE <br /> SYSTEMS OF NORTH AMERICA, INC., FOR A COMMERCIAL <br /> ORGANICS COLLECTION PROGRAM <br /> WHEREAS, the City of Redwood City ("City") and BFI Waste Systems of North <br /> America, Inc. ("BFI") entered into the "Franchise Agreement Between the City of <br /> Redwood City and BFI Waste Systems of North America, Inc., for Solid Waste, <br /> Recyclable Materials, and Plant Materials Collection Services" (the "Agreement"), dated <br /> as of September 9, 1999 and effective January 1, 2000; and <br /> WHEREAS, on June 12, 2000, the parties amended the Agreement to expand <br /> the collection of plant materials to include non-residential properties; and <br /> WHEREAS, City is a Member Agency of the South Bayside Waste Management <br /> Authority ("Authority"), and the Authority, on behalf of City, has requested a proposal <br /> from BFI for a Commercial Organics Collection Program; and <br /> WHEREAS, BFI has prepared a proposal in response to the Authority's request; <br /> and <br /> WHEREAS, Contractor and Agency now desire to amend the Agreement to <br /> incorporate the Commercial Organics Collection Program. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> Section 1.
