1 <br /> PUBLIC HEARING (continued) <br /> r <br /> Item No. 2 (continued) <br /> distinction is made between antique merchandise and used merchandise. <br /> Mr. Schroeter stated that there is no distinction made as to whether one <br /> requires a Use Permit and the other does not, because both require Use <br /> Permits. In response to further questions, he advised that the <br /> requirements of the Ordinance are consistently applied for sale of <br /> antique furniture under the definition of used merchandise, the latest <br /> being just two weeks ago for genuine antiques. He responded to question <br /> regarding application for an Architectural Permit, that no application <br /> for such a permit had ever been filed. <br /> Discussion by Council followed regarding tape recordings of the Zoning <br /> Administrator's hearings; the fact that the recommendation for <br /> revocation of the Use Permit would allow Alfa TV to sell only new <br /> merchandise; that there appears to be no provision in the ordinance to <br /> restrict or prohibit reapplication for a Use Permit. <br /> Mayor Biagi declared the public hearing closed at 8:15 p.m. <br /> City Attorney Schricker asked that the record show that the Council had <br /> closed the public hearing, but that it was specially reopened for the <br /> presentation by Mr. Hatfield. <br /> M/S: Leipzig/Chandler to revoke the Use Permit of Donna Tozi dba Alfa <br /> TV & Radio Service, 2050 Broadway, the sale of used furniture and <br /> household items for failure to comply with conditions of approval, and <br /> findings made that continuance of the Use Permit would be detrimental to <br /> the health, safety, morals, comfort and general welfare of the persons <br /> residing or working in the vicinity of such use, or would be injurious <br /> or detrimental to property and improvements in the vicinity or to the <br /> general welfare of the City, and that, upon making those findings, the <br /> use has become a nonconforming use; that in support of those findings <br /> are the fact that a Use Permit was issued on September 12, 1979 and tistroi conditions applied to the Use Permit have not been complied with; that <br /> the record supports that ample extensive attempts were made on behalf of <br /> the City to require compliance; that the permittee does require a Use <br /> Permit; and for failure to obtain the Architectural Permit in accordance <br /> with the Use Permit. <br /> The motion with findings carried unanimously by roll call vote. <br /> MINUTE ORDER NO. 81-164 <br /> It was suggested by Council that the taped recording of the Zoning <br /> Administrator hearings on the matter be retained. (memo 10/13/81) <br /> City Manager Fales suggested that Council might like some further <br /> research done on the question of used furniture as opposed to legitimate <br /> antiques, and Council agreed that it might be well for the City to <br /> establish some specific guidelines.
