7 <br /> A review of the provisions of the Zoning Ordinance which allows store front <br /> wpm <br /> churches in the downtown area was also suggested, and City Attorney <br /> Schricker pointed out that churches are allowed in any zone under the <br /> present Ordinance, and that by amendment, the ordinance could restrict <br /> churches to particular zoning districts, although they may not be excluded <br /> entirely. <br /> A question was raised regarding whether a Commissioner is obligated to base <br /> his vote on upholding an ordinance, or whether other factors may be allowed <br /> to enter into his decision. The example cited was the Historic Preservation <br /> ordinance, and a property owner objected to having his property so <br /> designated. Mayor Biagi noted that it is his understanding at a recent <br /> League of California Cities meeting that the consensus in the State is that <br /> if a property owner does not wish to have his property designated for <br /> historic preservation, he may not be forced to do so. It was noted that the <br /> issue is not specifically addressed in the ordinance. Mr. Schricker assured <br /> the Commission that a legislator is not required to explain his reasons for <br /> voting the way he does. <br /> Adjournment <br /> Upon motion duly made, seconded and carried, the Joint Meeting of the City <br /> Council and Planning Commission adjourned at 9:20 p.m. <br /> FRANCES I.
