PUBLIC HEARING (Continued) <br /> Item No. 1 (continued) <br /> In response to question, Planning Director Schroeter said that Condition <br /> No. 2 which prohibits use of Radio Road has no effect whatever on the <br /> easement BFI has from Redwood Shores, Inc. <br /> Paul F. Kelly, 181 Second Avenue, San Mateo, counsel for BFI, said the <br /> company agrees generally with the conditions of the Use Permit, but <br /> wishes to go on record that BFI is not giving up any rights with regard <br /> to the Radio Road easement. Mr. Kelly said BFI will cooperate with all <br /> the jurisdictions involved in establishing the transfer station. <br /> Lino Valbusa, Operations Manager, BFI, stated in response to question s' <br /> that the only washing to be done at the station will be the outside of <br /> trucks and that inside truck cleaning is done at the landfill site (Ox <br /> Mountain). <br /> Mr. Valbusa and Mr. Kelly requested a clarification of the meaning of <br /> "enclosed building" for washing required in Condition No. 8. <br /> (Councilman Bury arrived at 7:50 p.m.) <br /> Mr. Kelly also requested clarification of the use of "empty boxes" in <br /> Condition No. 6, stating that BFI uses large metal debris boxes, but <br /> does not expect to leave old cardboard boxes about the premises. <br /> Mr. Kelly urged that the Use Permit be valid for a period of 20 years, <br /> observing that the permit with San Mateo County is for 20 years and that <br /> financing would be impossible to obtain for a five-year period. He <br /> stated BFI does not object to a total review of operations every five <br /> years. <br /> Don Warren, President, Redwood Shores, Inc., 350 Marine World Parkway, <br /> rrr largest adjacent landowner to the transfer station, commented concerning <br /> his company's Radio Road easement granted to BFI, stating only emergency <br /> use of the road is contemplated. <br /> City Attorney Schricker confirmed that the easement is a private matter <br /> and the City is not involved. <br /> Charles A. Evans, Jr., 531 Anchor Circle, read from a newspaper clipping <br /> and placed it on file. Mr. Evans recommended the Use Permit be valid <br /> for possibly less than the five years granted with frequent reviews. <br /> John Murray, 568 Seahorse Lane, stated that he believes the conditions <br /> of the Use Permit are reasonable and urged that the Permit be valid for <br /> no more than five years. <br /> Gregg Doran, 510 Marlin Drive, President, Redwood Shores Homeowners <br /> Association, said that 20 years is too long for the Use Permit to be <br /> valid and that review should be more frequent than every five years. <br /> Mayor Biagi requested that the record show City Attorney Schricker's <br /> statement that at any time conditions of the Use Permit are not being <br /> met, the ordinance provides for revocation of the Use Permit and that <br /> there would be no need to wait for a specific review date. <br /> Mr. Kelly called attention to the 50-year history of the San Mateo <br /> County Scavenger Company's cooperation with the jurisdictions it serves. <br /> City Manager Fales stated for the record that with regard to use of <br /> Radio Road, the record would show that it is not the intention of the <br /> City Council, the Planning Commission or the staff to provide any set of <br /> circumstances which would allow interference in the proposed business <br /> park by the operation of the transfer station. <br /> Mr. Kelly acknowledged that his client is aware of City intention with <br /> regard to use of Radio Road and expects to cooperate. <br /> Reg.Mtg. <br /> 12/14/81 <br /> Page 2 <br />
