Public Hearing - Appeal of denial by Zoning Memorandum of Planning Director (Zoning <br /> Administrator of application for variance Administrator) 1/12/81 <br /> p,,,m to construct a six-foot sideyard fence with <br /> zero setback where 15-feet is required, Mayor Biagi declared open at 7:35 p.m. • <br /> 1603 Jefferson Avenue - Daniel-M. and - <br /> r.r Alene M. Karthas, appellants Affidavits of Publication of Notice of Hearing <br /> . and of Mailing reported on file. <br /> In response to question, Planning Director <br /> Schroeter advised that a variance was granted <br /> to permit a six-foot fence with an eight-foot <br /> sideyard setback where 15 feet is required <br /> because the house on the property has only an <br /> eight-foot setback and the fence could be <br /> aligned with it. Mr. Schroeter stated that the <br /> eight-foot variance did not satisfy the <br /> appellants who wish to have zero setback. <br /> Daniel M. and Alene M. Karthas, appellants, <br /> stated they did not receive notice from the <br /> City relating to the illegal fence until after <br /> the fence was built. They acknowledged they <br /> did not apply for a permit and suggested there <br /> are many similar violations and inquired as to <br /> the intent of the Zoning Ordinance which pro- <br /> hibits the construction of a fence such as <br /> theirs. <br /> In response to request, Mr. Schroeter explained <br /> that the Zoning Ordinance represents the com- <br /> munity's wishes with regard to setbacks and <br /> fence heights, noting the City's regulations <br /> are similar to those in most cities and that <br /> compliance in the City is general, suggesting <br /> the community prefers the open appearance that <br /> presently exists. <br /> Discussion followed and Mr. Schroeter com- <br /> mented and replied to questions concerning the <br /> number of times Mr. and Mrs. Karthas were <br /> Adj.Mtg. <br /> 1/26/81 <br /> • <br />
