461
•
AGENDA (continued) ACTION TAKEN (continued)
-REPORTS OF CITY MANAGER (continued) REPORTS OF CITY MANAGER (continued)
• 4. (continued) requiring item pricing by operators of
grocery stores and to set a public hearing for
consideration of it. Mr. Smith suggested item
pricing protects the consumer and makes com-
parison shopping within the store and with
prices offered in other stores possible. He
also suggested that enforcement cost should be
. expected to be minimal.
Discussion followed and Mr. Smith commented
and replied to questions concerning the manner
in which consumers would be protected by item
pricing; the apparent desire of shoppers for
such pricing; and the desirability of shelf
per unit pricing also. -
M/S: Bury/Rhodes to direct staff to develop
an ordinance to require item pricing by
grocery store operators.
Fred Moore, 30 Cape Hatteras Court, attorney
representing Alpha Beta Stores, advised that.
his company is installing scanners which
makes item pricing unnecessary for grocery -
clerks at checkout stands and provides other .
benefits which can result in lower costs;
that if item pricing is to be required it
should be handled at the State level so that
each jurisdiction in which the store operates
does not make different requirements which
increase costs to the consumers inevitably;
ping
and invited Council members to see a demon-
stration of the scanner and its itemized tape.
In responding to questions, Mr. -Moore pointed •
M out that consumers can decide whether or not
they wish to have item pricing through their
shopping practices in refusing to shop where
such marking is not used, stating stores
would prefer to use or not use item pricing
as a business decision rather than a require-
ment.
AMENDMENT: Councilman Chandler made the
following amendment which was accepted by
the maker of the motion and his second: that
all grocery stores of whatever size be re-
quired to mark prices on items.
The motion as amended failed on the following
roll call vote:
Ayes: Councilmen Bury, Rhodes and Mayor
Biagi
• Noes: Councilmen Britschgi, Chandler,
Leipzig and Stangel
CONSENT CALENDAR CONSENT CALENDAR .
MOTION: Stangel/Leipzig to waive reading of
the Consent Calendar, adopt the resolution
and approve all other items.
Carried unanimously by roll call vote.
5. MOTION: to accept Resurfacing Project MINUTE ORDER NO. 81-26
1980-81 (Raisch Construction Company)
6. MOTION: to accept Water Main Replacement MINUTE ORDER NO. 81-27
Project 1979-80 (Cupertino Pipeline, Inc.)
Reg.Mtg. •
2/2/81
Page 7
• t
