285 <br /> It was also reported that there has been comment concerning public <br /> hearing procedure by the Commission in that Commissioners may not <br /> realize that the public hearing is for the purpose of taking testi- <br /> mony, asking question related to the testimony designed only to <br /> obtain additional information or clarifications and to consider all <br /> of the evidence presented before closing the hearing, holding Com- <br /> rft mission discussion and making the decision. Any discussion or <br /> debate with the applicant is inappropriate. <br /> Iwo <br /> City Attorney Schricker pointed out that from the legal standpoint, <br /> it is necessary to be sure that a fair hearing is given to all and <br /> that decisions are made on the basis of evidence, noting that on some <br /> occasions the Commission is acting in a quasi-judicial capacity. In 4 <br /> response to questions, Mr. Schricker said that it is acceptable to <br /> set a time limit applicable to all speakers and to ask speakers not <br /> to bring up points already stated, advising that it is not proper <br /> for Commissioners to become involved in making suggestions for a <br /> development and then to vote on the relevant application. <br /> In response to request, Mr. Schricker advised he will be happy to <br /> make arrangements to have a member of his department speak to the <br /> Commission on the legal aspects of their duties and responsibilities. <br /> (memo 7/1/80) <br /> Discussion continued relating to the present satisfaction of Commis- <br /> sioners with the changes in assignment to the Commission which leaves <br /> many decisions to the Zoning Administrator and reduces time for 4 <br /> handling routine matters, while permitting the Commission to undertake <br /> long range planning. <br /> Planning Director Schroeter reported as a matter of information on a <br /> proposed use of the small piece of property at Whipple and El Camino <br /> Real , commenting on the considerations involved in attempting to get <br /> good quality development on a very small piece of land, while being <br /> realistic about the possible uses for the property. <br /> Adjournment <br /> Upon motion duly made, seconded and carried the Joint Meeting was <br /> adjourned at 11:00 p.m. <br /> JACQUELINE C.
