Pamela D. Carlston, Western Traction Company, Union City, referred to her letter of <br /> July 3, 1980 relating to her unsuccessful bid on a truck-mounted hydraulic sewer <br /> cleaner. (See also her communication of June 16; response to the letter and report <br /> of City Manager, both of June 27; memorandum from City Attorney of June 23; joint <br /> memorandum of Director of Finance and Director of Public Works.) Ms. Carlston re- <br /> quested a response from Council to review the bids in light of the explanation of <br /> her bid which she has provided. <br /> City Attorney Schricker advised that two possible actions are available to Council <br /> as a policy matter - either to rescind the agreement with the successful bidder and <br /> call for bids again or to continue in the agreement with him. Mr. Schricker <br /> advised reformation of the Western Traction bid is not possible. <br /> Discussion followed and Ms. Carlston commented and replied to questions regarding <br /> her bid, urging that Council rescind their action in awarding the bid and call for <br /> bids again. She suggested her bid was proper as she understood the bid form and <br /> acknowledged that she did not submit a bid on the stainless steel tank which the <br /> City selected. <br /> City Manager Fales pointed out that the successful bidder completed the bid form <br /> correctly in the manner anticipated by staff and suggested that if confusion existed, <br /> Ms. Carlston could have asked questions before submitting her bid. <br /> Mr. Schricker stated that the Western Traction bid is not responsive to what was re- <br /> quested, since incremental differences cannot be determined from that bid, noting it <br /> is standard bid practice to request such differences. He stated that the error is of <br /> a type which requires explanation, not clearly a clerical or other patent error which <br /> can be corrected, and observed that the evidence is that the successful bidder had no <br /> trouble with the form. <br /> CONSENSUS: Mayor Biagi determined it to be the consensus of Council to allow the <br /> agreement for award of bid on the sewer flusher truck to remain as awarded.
