8.A. - Page 133 <br /> Exhibit E. Insurance Requirements <br /> The Buyer acknowledges that some insurance requirements contained in this Agreement may be <br /> fulfilled by self-insurance on the part of the Seller. However, this shall not in any way limit <br /> liabilities assumed by the Seller under this Agreement. Any self-insurance shall be approved in <br /> writing by the Buyer upon satisfactory evidence of financial capacity. Seller's obligation <br /> hereunder may be satisfied in whole or in part by adequately funded self-insurance programs or <br /> self-insurance retentions. <br /> The Buyer acknowledges that some insurance requirements contained in this Agreement may be <br /> fulfilled by a combination of primary and excess liability policies. However, this shall not in any <br /> way limit liabilities assumed by the Seller under this Agreement. <br /> The Buyer reserves the right to withhold payments to the Seller in the event of material <br /> noncompliance with the insurance requirements outlined below. <br /> B. DESIGN PHASE INSURANCE REQUIREMENTS <br /> Insurance required during the design phase will include: <br /> 1. Commercial General Liability Insurance for bodily injury (including death) and property <br /> damage which provides limits as follows: <br /> a. Each occurrence-$2,000,000 <br /> b. General aggregate-$2,000,000 <br /> c. Personal Injury-$2,000,000 <br /> 2. General liability coverage shall include: <br /> a. Premises and Operations <br /> b. Personal Injury liability <br /> c. Severability of interest <br /> 3. General liability coverage shall include the following endorsement, a copy of which shall be <br /> provided to the Buyer: <br /> The additional insured requirement described above applies to each Agreement, with the specific <br /> entity and its respective related parties substituted for the City of Redwood City. In all cases, the <br /> additional insured endorsement shall be at least as broad as ISO Form CG 20 <br /> 380413. <br /> 4.
