06/07/2004
measures are identified in Mitigation 7 -1 These additional alternative measures are: 1)
reconstruction of the Whipple Avenue CalTrain railroad crossing to provide a grade -
separated crossing; or 2) widening of the eastbound approach to the intersection.
Additionally, the Project is required under the Marina Shores Precise Plan to achieve a
fifteen percent (15 %) reduction in trips through implementation of Transportation
Demand Management programs ( "TDM "). This requirement is fully enforceable by a
provision which permits the City to withhold building permits if the 15% reduction is not
achieved.
Findings: Adoption of the Project, in place of the Initial Project, results in
this impact being less than significant. The addition of a receiving lane for westbound
right -turns is feasible and will further reduce the impact described above. Neither of the
two additional mitigations proposed in Mitigation 7 -1 is feasible, because neither
alternative is fully within the control of the project applicant or the City.
B. Project Impact on U.S. 101 Southbound Mixed -Flow Lanes, Whipple
Avenue to Woodside Road Segment — AM Peak Hour
Potential Impact: The Project is expected to increase traffic volumes by
more than one percent of the U.S. 101 Southbound Mixed -Flow Lanes, Whipple Avenue
to Woodside Road segment's capacity during the AM peak hour, a period during which
it already operates at an unacceptable level of service (Impact 7 -2).
Mitigation: The project applicant shall design and implement a
comprehensive transportation demand management ( "TDM ") program meeting the
criteria set forth in Mitigation 7 -2.
Findings: Mitigation 7 -2 is feasible and will help to partially mitigate
Impact 7 -2. However, mitigation of this impact to a less- than - significant level would
require the addition of another southbound through lane to the freeway segment, which
is not feasible because this freeway widening would require multiple approvals from
multiple jurisdictions beyond the authority of the City and would require resources
beyond the capacity of any individual development project or the City. Therefore, the
effect of the Project on this freeway segment during the AM peak hour is a significant
unavoidable impact.
C. Project Impact on U.S. 101 Southbound Mixed -Flow Lanes, Woodside
Road to Marsh Road Segment — AM Peak Hour
Potential Impact: The Project is expected to increase traffic volumes by
more than one percent of the U.S. 101 Southbound Mixed -Flow Lanes, Woodside Road
to Marsh Road segment's capacity during the AM peak hour, a period during which it
already operates at an unacceptable level of service (Impact 7 -2).
Mitigation: The Project shall be required to implement a TDM program
meeting the criteria set forth in Mitigation 7 -2 (Mitigation 7 -3).
1289 \02 \179278.2 $
Atty /Reso /Reso.1470 14590
060804 Muff # 304 Bin 26
