Parkway site; provided, however, Developer's total expenditure of funds to construct the <br /> Oracle Parkway East Improvements shall not exceed the sum of $359,000, which expenditure <br /> shall satisfy in full Developer's obligations under this Paragraph 5, and further provided that <br /> fifty percent (50 %) of the funds so expended shall be credited to Developer as provided in <br /> Paragraph 9(b) of the Agreement. <br /> 6. AMENDED PROVISIONS RELATING TO COSTS. FEES AND CHARGES. ..... <br /> Q <br /> The following provisions of Paragraph 9 of the Existing Development Agreement are hereby 0) <br /> amended to read as follows: <br /> "9. COSTS. FEES AND CHARGES. <br /> (a) Facilities Fees. Certain public improvements ("Facilities") must be <br /> constructed as a result of, and for the benefit of the orderly development of all property <br /> within the District, including the Property. Such improvements consist of all Facilities <br /> as determined by City, for itself, and on behalf of District, to be of benefit to the <br /> District as a whole. <br /> The Facilities constructed prior to 1983 were financed by General Obligation <br /> Bonds issued by the District. Pursuant to Minute Order No. 83-22, adopted February <br /> 28, 1983 , and implemented by Resolutions No. 9304, 9305 , 9306 and 9307, adopted <br /> February 28, 1983, the City Council deauthorized outstanding bonds for funding of <br /> Facilities in the District following its declared intent, upon the adoption of Ordinance <br /> No. 1859, on May 24, 1982, that future Facilities should be financed by the developers <br /> of new developments in the District, and not by the general funds of the City. <br /> 10 06692\2MF107!.DOC:122365 <br />
