The Facilities and the amounts to be credited against Developer's obligation to <br /> pay Facilities Fees hereunder, are as follows: <br /> Project Maximum Credit <br /> (1 ) Exterior levee system * $ 173 ,000 <br /> (2) Signalization * $ 160,000 <br /> (3) Pump station and force main * $385,000 <br /> (4) Marine World Parkway (50 % ) ** $400,000 «-, <br /> (5) Oracle Parkway East Improvements (50 %) ** $179,500 _ <br /> (* As of the date of this Second Amendment, Developer has completed these projects <br /> and received the credits to which it is entitled with respect thereto.) <br /> 01 <br /> (** Developer is solely liable for 100 % but will be credited for 50 % of the actual <br /> costs of these improvements up to a maximum credit of $400,000 in the case of the <br /> Marine World Parkway project ($ of which credit Developer has already <br /> received) and $179,500 in the case of the Oracle Parkway East Improvements.) <br /> Credits shall be given as of the completion of each project, and shall apply <br /> toward the payment of future Facilities Fees; provided, however, in the event that <br /> Developer provides a bond in a form reasonably acceptable to the City in the full <br /> amount of the Oracle Parkway East Improvements, Developer shall be entitled to an <br /> immediate credit against any Facilities Fees payable with respect to 600 Oracle <br /> Parkway; provided further, that in the event the Oracle Parkway East Improvements <br /> are not completed within five (5) years after the credit is received by Developer, <br /> Developer will refund the credit to City, which refund City will then hold until such <br /> time as the Oracle Parkway East Improvements are completed at which point the <br /> refunded credit will be returned to Developer.
