Such improvements consist of all <br /> Facilities as determined by City , for itself , and on behalf <br /> of District , to be of benefit to the District as a whole . <br /> The Facilities constructed prior to 1983 were financed <br /> by General Obligation Bonds issued by the District . <br /> Pursuant to Minute Order No . 83 - 22 , adopted February 28 , <br /> 1983 , and implemented by Resolutions No . 9304 , 9305 , 9306 <br /> and 9307 , adopted February 28 , 1983 , the City Council <br /> deauthorized outstanding bonds for funding of Facilities in <br /> the District following its declared intent , upon the <br /> adoption of Ordinance No . 1859 , on May 24 , 1982 , that future <br /> Facilities should be financed by the developers of new 00 <br /> developments in the District , and not by the <br /> CD <br /> p y general funds cop <br /> of the City . Pursuant to the above- stated policy of the O O; <br /> Ca <br /> City Council , and in consideration of the rights to develop <br /> the property pursuant to this Agreement , Developer shall pay <br /> to City , for construction of Facilities within the District , <br /> fees as hereinafter described : <br /> ( 1 ) Fees shall be payable on an E . D . U . basis , at the time <br /> building permits are applied for , for all phases of the <br /> Project , including the hotel , in accordance with the <br /> actual square footage applied for by Developer . <br /> ( 2 ) The E . D . U . equivalency charges shall be the same as <br /> those charged for development under the provisions of <br /> the fee schedule set forth in " Exhibit A" of that <br /> certain Development Agreement adopted pursuant to the <br /> aforesaid Ordinance No . 1859 . Developer shall not be <br /> liable for payment of any increases in such charges <br /> beyond the scheduled increases set forth in " Exhibit <br /> A" , unless Developer is a member of the Committee <br /> hereinafter described in paragraph 9 ( f ) at the time any <br /> 11 <br />
