13.31 DEBT LIABILITY DISCLAIMER <br /> The Buyer, including, but not limited to,any source of funding for Buyer,any general fund <br /> or any special self-insurance program, is not liable for any debts, liabilities, settlements, <br /> liens, or any other obligations of the Seller or its heirs, successors or assigns. Buyer is not <br /> be liable for and shall be held harmless and indemnified by Seller for any claims or <br /> damages arising out of any other contract to which Seller is a party,tort,action or inaction, <br /> negligent error in judgment, act of negligence, intentional tort, negligent mistakes or <br /> other acts taken or not taken by the Seller, its employees, agents, servants, invitees, <br /> guests or anyone acting in concert with or on behalf of the Seller. Buyer and its agencies <br /> and divisions, has no obligation to defend or undertake the defense on behalf of the Seller <br /> or its heirs, successors or assigns. <br /> 13.32 USE OF BUYER'S NAME FOR COMMERCIAL PURPOSES <br /> Seller may not use the name of the Buyer or reference any endorsement from the Buyer <br /> in any fashion for any purpose, without the prior express written consent of the Buyer. <br /> 13.33 ACCOUNT MANAGER <br /> Seller must assign an account manager to Buyer to facilitate the contractual relationship, <br /> be fully responsible and accountable for fulfilling Buyer's requirements.
