�' � <br /> 5.8 Technical Standards <br /> (a) The Grantee shall construct, install, operate and maintain its <br /> Cable System in a manner consistent with all applicable laws, ordinances, <br /> construction standards, governmental requirements and FCC technical <br /> standards (Part 76, Subpart K, as amended from time to time). In addition, the <br /> Grantee shall provide to the Grantor, upon written request, a written report of the <br /> results of the Grantee's periodic proof of performance tests conducted pursuant <br /> to FCC and Franchise standards and guidelines. <br /> (b) Should the FCC no longer require proof of performance <br /> tests, the Grantee shall make and submit such proof of perFormance tests and <br /> reports in response to a written request from the Grantor. Such report shall be <br /> submitted to the Grantor within thirty (30) days of issuance of the Grantor <br /> request. <br /> 5.9 Right of Inspection <br /> Grantor shall have the right to inspect all construction, reconstruction or <br /> installation work performed subject to the provisions of the franchise and other <br /> pertinent provisions of law, and as part of Grantor's obligation to protect the <br /> public health, safety and welfare of its citizens. <br /> 5.10 Abandonment or Removal <br /> (a) If the Grantee discontinues the use of any of its Cable <br /> System components within the Public Way for a continuous period of twelve (12) <br /> months, such property shall be deemed to have been abandoned by Grantee. <br /> Any part of the Cable System that is parallel or redundant to other parts of the <br /> System and is intended for use only when needed as a backup for the System or <br /> a part thereof, shall not be deemed to have been abandoned because of its lack <br /> of use. <br /> 36 <br /> sh/RWC/Council <br /> AGMT-382 <br /> FXS/fs <br /> O8/02/00 <br />
