7.2 Compliance with Federal Law <br /> In accepting this Franchise, the Grantee agrees that the commitments <br /> indicated in Section 7.1 above are voluntarily entered into and shall not be <br /> charged against any Franchise Fees due the Grantor during the term of the <br /> Franchise. The Grantee agrees to meet all of the commitments of Section 7.1 <br /> above, through the term of the Franchise. <br /> SECTION 8 REGULATION <br /> 8.1 Franchise Regulation <br /> The Franchise granted under this Agreement shall be subject to regulation <br /> by Grantor in accordance with all of the applicable provisions of Federal and <br /> California law and this Agreement. <br /> 8.2 Force Majeure <br /> In the event Grantee's perFormance of any of the terms, conditions or <br /> obligations required by this Agreement is prevented by a cause or event not <br /> within Grantee's control, such inability to perform shall be deemed excused and <br /> no penalties or sanctions shall be imposed as a result thereof; provided, <br /> however, that such inability to perform shall not relieve a Grantee from the <br /> obligations imposed by Section 9.3(c) pertaining to refunds and credits for <br /> interruptions in service. For the purpose of this Section, causes or events not <br /> within the control of Grantee shall include without limitation acts of God, war, <br /> strikes, sabotage, riots or civil disturbances, labor disputes, restraints imposed <br /> by order of a governmental agency or court, explosions, acts of public enemies, <br /> and natural disasters such as floods, earthquakes, landslides, and fires, or any <br /> other similar event not reasonably within Grantee's control or reasonably <br /> foreseeable by Grantee, which shall include, but not be limited to, delays caused <br /> 41 <br /> sh/RWC/Council <br /> AGMT-382 <br /> FXS/fs <br /> 08/02/00 <br />
