Ravella, a <br /> married man, as his sole and separate property, as to an undivided 35% interest and O'Neill <br /> Edgewood, LLC, a California limited liability company, as to an undivided 50% interest, and <br /> Albino A. Ravella and Antonia T. Ravella, Trustees of the 1983 Ravella Living Trust, as to an <br /> undivided 15% interest ("Developer"), and the CITY OF REDWOOD CITY, a charter city and <br /> California municipal corporation("City")with reference to the following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting of <br /> approximately 1.31 acres located within the City of Redwood City, County of San Mateo, State of <br /> California,described in Exhibit A,attached hereto and incorporated herein by reference(the"Property"). <br /> B. On January 18th,2011, the Planning Commission of the City of Redwood City approved <br /> by motion a Planned Development Permit, Mitigation and Monitoring and Reporting Program for an <br /> Initial Study and Mitigated Negative Declaration, along with an Vesting Tentative Parcel Map for the <br /> Planned Development Permit at 1250 Edgewood Road("Project"),prepared by MacLeod and Associates <br /> and dated January 8th,2010 ("Tentative Map"),subject to certain conditions of approval("Conditions"). <br /> C. The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the parcel map ("Final/ Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and,therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1), <br /> E. Developer has submitted to City plans, specifications and drawings entitled On-site and <br /> Off-site Improvement Plans, 1250 Edgewood Road,Redwood City, California,prepared by MacLeod and <br /> Associates, Inc and dated September 19, 2014 (the "Improvement Plans"), which, in addition to other <br /> improvements, provide for certain on-site public improvements consisting of street and street light <br /> improvements, storm drain systems, domestic water systems and sanitary sewer systems for the Project <br /> (collectively,"Improvements"). <br /> ATT,'/AGR/2015.048/IIMPROVEMENT AGR—1.250 EDGEWOOD RD <br /> REV:11-10-14 VR <br /> Page 1 of 19 <br />
