9.A. - Page 13 <br /> Section 5. Section 9.3 of Chapter 9 — Buildings, of the City Code, is amended <br /> to read as follows: <br /> Sec. 9.3. - VIOLATIONS AND PENALTIES: <br /> A. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, <br /> improve, remove, convert, demolish, equip, use, occupy or maintain any building <br /> or structure in the City or cause the same to be done contrary to or in violation of <br /> any code provision as adopted by this Chapter or any amendment thereto as <br /> adopted by this Chapter. <br /> B. Any person, firm or corporation, whether as principal, agent employee, or <br /> otherwise, who shall violate or cause the violation of any of the provisions of the <br /> codes or amendments adopted by this Chapter, or fail to comply with any order, <br /> license or permit made or issued thereunder, or who shall build or install in violation <br /> of any detailed statement of specifications or plans submitted and approved <br /> thereunder and from which no appeal has been taken, or who shall fail to comply <br /> with such an order, license or permit as affirmed or modified by the Council or by <br /> a court of competent jurisdiction within the time fixed therein, shall severally, for <br /> each and every such violation and noncompliance thereof, shall be punishable as <br /> provided in Section 1.7B of this Code. The imposition of any one penalty for any <br /> violation shall not excuse the violation or permit it to continue. Each and every day <br /> a violation shall continue shall be deemed to be a separate violation. <br /> Notwithstanding the foregoing, any person, firm or corporation violating Section <br /> 903.2.13(e) regarding Automatic Sprinkler Systems shall be deemed guilty of a <br /> misdemeanor, and each such person, firm or corporation shall be deemed guilty <br /> of a separate offense for each and every day or portion thereof during which such <br /> violation exists and shall be punished as set forth in Section 1.7A of the Redwood <br /> City Code. The act of violating Section 903.2.13(e) shall include maintaining a <br /> property without an Automatic Sprinkler System as required by Section <br /> 903.2.13(e). <br /> C. The Building Official or the authorized representatives of the Building Official shall <br /> have the authority to issue citations for violations of the codes or amendments <br /> adopted by this Chapter, and all orders, licenses, certificates, permits, and plans <br /> and specifications issued or approved thereunder. <br /> Section 6. In recognition of the planning and resources necessary to implement <br /> the requirements of this ordinance, compliance shall be voluntary for the first five years <br /> but strongly encouraged. The City Council in its sole discretion may provide certain <br /> economic incentives to encourage compliance as more fully set forth by a resolution of <br /> the City Council. <br /> Section 7. Public nuisance declared.
