9.A. - Page 25 <br /> increases imposed over the entire five year period (5%). <br /> However, if a proposed Borrower submits a Program Loan <br /> Application on July 1, 2015, and the proposed Borrower had <br /> increased rents in the Eligible Building since July 1, 2010 as <br /> follows: 6/1/11 – 5%; 6/1/12-5%; 6/1/13-5%; 6/1/14- <br /> 5%; and 6/1/15-10%, then the increase within the last <br /> twelve (12) months (10%) would be greater than the <br /> average of the increases imposed over the entire five year <br /> period (6%). <br /> ii. The Program Manager may allow for greater increases in <br /> rent charges during the twelve (12) months immediately <br /> preceding the date of submission of the Owner's Program <br /> Application and continuing through the date of the Loan <br /> Agreement reasonably justified by capital improvements or <br /> upgrades made to the subject rental units other than the <br /> installation of the Automatic Sprinkler System. <br /> b. From the date the Rent Stabilization Program Loan is approved, the <br /> Borrower shall not: <br /> i. Increase rental rates without first providing at least ninety <br /> (90) days written notice to tenants; or <br /> ii. Increase rental rates during any twelve (12) month period <br /> by more than the annual Consumer Price Index—All Urban <br /> Consumers for San Francisco-Oakland-San Jose, CA, (Series <br /> Id. CUURA422SA0) as regularly published by the United <br /> States Department of Labor, Bureau of Labor Statistics for <br /> the applicable period of time and as verified by the Program <br /> Manager, or five percent (5%), whichever is lower. <br /> iii. The Program Manager may allow for greater increases in <br /> rent charges during any twelve (12) months reasonably <br /> justified by capital improvements or upgrades made to the <br /> subject rental units other than the installation of the <br /> Automatic Sprinkler System. <br /> c. The Borrower must submit a written statement to the Program <br /> Manager annually verifying that rents in the Eligible Building have <br /> ATTY/RESO.3085/CC RESO—RWC FIRE SAFETY FIRST PILOT PROGRAM—ATTACHMENT A <br /> REV:05-12-15 VR <br /> Page 9 of 10 <br />
