Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> (1092 Second Ave) <br /> THIS IMP • • V 'MEN T'AGREEMENT ("Agreement") is made and entered into on this <br /> day of 1L:4I 1 , 204 ("Effective Date") by and between by and between Michael C schin, <br /> a single man, as of in undivided 75% interest and Nicholas Ceschin and Belinda Ceschin, <br /> husband and wife as community property with right of survivorship, as to an undivided 25% <br /> interest ("Develope "), and the CITY OF REDWOOD CITY, a charter city and California <br /> municipal corporation ("City") with reference to the following facts: <br /> RECITALS <br /> A . Developer is the current fee owner of that certain real property consisting of <br /> approximately 0.239 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B . On September 17, 2014, the Planning Commission of the City of Redwood City <br /> approved the Tentative Parcel Map for the property at 1092 Second Ave ("Project"), prepared by Pat <br /> McNulty and dated May 28, 2014 ("Tentative Map"), subject to certain conditions of approval <br /> ("Conditions"). <br /> C . The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the Parcel map ("Final/Parcel Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D . Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E . Developer has submitted to City plans, specifications and drawings entitled 1092 Second <br /> Avenue Subdivision Improvement Plans, prepared by Clifford Bechtel and dated March 19, 2015 (the <br /> "Improvement Plans"), which, in addition to other improvements, provide for certain on-site public <br /> improvements consisting of street and street light improvements, storm drain systems, domestic water <br /> systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br /> F .
