Code § 27383. <br /> <br />IMPROVEMENT AGREEMENT <br />Jefferson and Franklin (103 Wilson) <br /> <br />THIS IMPROVEMENT AGREEMENT (“Agreement”) is made and entered into on this day of <br /> , 20__ (“Effective Date”) by and between by and between REDWOOD CITY <br />JEFFERSON, LLC, a Delaware limited liability company (“Developer”), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation (“City”), with reference <br />to the following facts: <br />R E C I T A L S <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 1.1 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the “Property”). <br />B. On October 14, 2014, the Planning Commission of the City of Redwood City adopted, <br />among other approvals, Resolution No. 14-19, approving the Vesting Tentative Map for the 103 Wilson <br />Street Project (“Project”), prepared by BKF Engineers and dated September 17, 2014 (“Tentative Map”), <br />subject to certain conditions of approval (“Conditions”). <br />C. The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the parcel map (“Final Map”), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled Jefferson and <br />Franklin Improvement Plans, prepared by BKF Engineers and dated ___________, 20__ (the <br />“Improvement Plans”), which, in addition to other improvements, provide for certain on- and off-site <br />public improvements consisting of street and street light improvements, storm drain systems, domestic <br />water systems and sanitary sewer systems for the Project (collectively, “Improvements”). A portion of <br />the Improvements as described in Exhibit B attached hereto and incorporated herein by reference consist <br />of off-site transportation related improvements (“TIF Eligible Improvements”) a portion of which are <br />eligible for funding under the City’s Transportation Impact Fee program as set forth in Article XV of the <br />Redwood City Code. <br />ATTY/AGR/2015.107/GREYSTAR - 103 WILSON - IA WITH TIF CREDIT <br />REV: 05-28-15 VR <br />Page 1 of 27 <br />7.1.D. - Page 37
